Edit:
If the foreground sprite has nearly the same angle as the background sprite, the draw order is correct.
Else the draw order is messed up.
I smell an engine bug, what do you think ?

this happens allot, when i summon my zaky at the beach, the legs are there, but the water form the ocean covers his torso up :P then the bug dissapears when i move
