1) If you attack an animal from behind, will that give you a bonus to hit with spells or weapons?
2) If you recieve a "worn" item as a drop or in a quest, what does this mean? Can this item be repaired at a merchant?
1) No.
2) It means nothing. I've seen worn items with the quality of fine steel items, although I don't know how it works.

I think lower durability on the worn items, compared to the same item of the same level, although i never did actually compare them..just seems logical..if it aint..well, i dont wanna know who wore it first..

The point of worn items is that they originally are only available to higher levels, but due to the fact that they are worn they can be used at lower levels already.
An example: the Warlord Axe for knights starts at level 49 in stores, but the worn version can be equipped at level 48.
Usually these items, even though they have a malus for damage/hitchance/armor points, are well worth equipping.
And yes, they can be repaired.

But I assume that this item will always be "worn" i.e. it will always have a slight damage penalty and so on (in the same way other items are enhanced or superior)?

Yes, exactly. Worn items are just like any other items in these respects.
